Uniform Hero (Jupetar Pty. Ltd.) Terms & Conditions of Sale (Service Agreement)

In using this website to place an order or by paying an invoice you are deemed to have read, understood and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions and any or all Agreements: "Customer", "Client", "You" and "Your" refers to you, the person accessing this website and accepting Uniform Hero's terms and conditions. "The Business", "Ourselves", "Our", "We" and "Us", refers to Jupetar Pty Ltd Trading as 'Uniform Hero'. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore referring to the same.

Uniform Hero’s Services

Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. Where the Client terminates the agreement and a service is deemed to have begun and is, for all intents and purposes, underway, no refund shall be offered to the Client. At our discretion, if the Client cancels an order that is underway, we may offer a partial refund if such a refund does not result in a financial loss to Uniform Hero. Where we terminate the agreement, for whatever reason, any monies that have been paid to us by the Client shall be refunded.

Changes to an Order Once Placed

Requests for changes to be made to an order after it has been placed will be accepted at our discretion. If the Client wishes to make a change to an order that is underway, we will accept the change to the order only if carrying out such a change does not result in a financial loss to Uniform Hero.

Delivery Times

Uniform Hero endeavours to turn around orders in 2-3 weeks from the date that payment for the order has cleared, however, this order turn around time is not guaranteed. Payment by eCheck/Direct Deposit/Personal Check or other non-credit card based payment will result in additional processing time due to the time required for funds to clear. Turn around time refers to the date of shipping by Uniform Hero, not the date of receipt of goods by the customer.

Stock Availability

If stock is unavailable the Client will be notified via the email address used to place the order to ask if the Client would prefer to: Wait until the unavailable stock is available; or, Modify the order for a substitute product and/or size; or, Cancel the order and receive a full refund. Any delay by the Client in replying to Uniform Hero's communication may result in additional processing time for the order.

Product Defects

Where there is a legitimate defect in the product due to erroneous manufacture (e.g. poor quality stitching/decoration peeling etc.) Uniform Hero will replace the item for the Client or offer the Client a refund for the cost of the item as soon as the issue is brought to our attention.

General Item Sizes

Where available, Uniform Hero publishes characteristic physical size information of products offered on this website as specified by the manufacturer of each product. Sizes are approximate and may vary slightly from item to item within the usual manufacturing tolerances for garments (1 inch/2.5cm). The Client is responsible for ensuring that correct sizes are selected by using the size in inches/cm as provided on this website. No refunds will be given for items that have been decorated and which the Client subsequently decides is an incorrect size. Where the Client made a decision to order a item of a specific size based on erroneous sizing information, Uniform Hero will replace the item with a item of the required size or offer a refund for that item.

Colours of Products (Including Decoration)

Uniform Hero endeavours to represent the colours of products faithfully, including decoration (any form of print or heat transfer vinyl added to a garment), and as close as possible to the colours of the real product on this website. However, as it is technically impossible to guarantee that any given colours the Client views on any particular device used to place an order is an accurate depiction of the physical product, no refunds will be given where the Client subsequently decides that the colours of the product is different from that from which they viewed on the device used to place the order.

Uploaded Images for Printing

Uniform Hero reserves the right to modify images uploaded to ensure they are suitable for the manufacture process. Where significant changes are required to an image, the Client shall be consulted before the image is used to decorate an item. Where the Client uploads an image that is unsuitable for printing due to poor image quality, low resolution, poor contrast or other characteristic that would make the image unsuitable for use as a decoration without a significant amount of time to be spent by us preparing it for manufacture, or would make the manufacturing process difficult, Uniform Hero reserves the right to reject the image for use. In this instance the Client will be asked to provide a more suitable image for printing. The particular reason as to why the image was rejected will be provided at the time of rejection and we will suggest ways to correct this. Should the Client no longer wish to proceed without the rejected image, a full refund will be offered to the Client.

Copyright Ownership

By uploading an image to the website you guarantee that you are the legal owner of the copyright of that image, have been awarded full and unrestricted rights from the copyright owner to upload and utilise the image for the purposes of this website, or are otherwise entitled by law to upload and utilise the image for the purposes of this website. By uploading an image you guarantee that such use of the image for production of printed clothing does not violate the rights of any other party, does not result in a breach of contract between you and another party and that you accept responsibility for any royalties or fees due to any other party from the use of the uploaded image. We reserve the right to request verification of copyright ownership or permission at any time, and to decline or cancel any orders that involve the use of logos for which appropriate authorization cannot be substantiated.

Promotional Material

The Client agrees that any images uploaded that form part of a design to be printed on a garment or designs created on this website may be used by Uniform Hero for promotional purposes.

Text Entered on Website for Printing

Uniform Hero will print any text exactly as it is entered on the website. This includes any misspelt words or names. Uniform Hero will not be held responsible for print that was originally entered incorrectly by the Client. In the event that Uniform Hero prints any text with a spelling that is different to that submitted by the Client during the ordering process, Uniform Hero will replace the item with the correct text printed, or offer a refund for that item.

Duties and Taxes

For international shipments (all delivery destinations outside Australia or the United States) the Customer is the importer of the goods and is required to pay any applicable duties and taxes. Uniform Hero shall not be liable for any duties and taxes levied on the shipment of an order.

Undeliverable Goods

The Client assumes full responsibility for providing an accurate shipping address. Any goods that are unclaimed by the Client or returned to Uniform Hero due to an inaccurate address will be subject to additional shipping charges being incurred by the Client.

Rush Shipping

Where rush shipping is available and has been selected and paid for by The Client, the following conditions apply: Rush shipping is contingent on stock availability and the print of your order not requiring edits. If rush shipping is not possible for any reason, we will contact you within 2 business days. You will be asked if you want to continue with normal shipping options (rush fees will be refunded) or will be offered a full refund if you choose not to proceed with your order. Rush shipping may be unavailable for some remote regions. You will be contacted if this applies. Rush shipping availability may change at our discretion depending on operational requirements.

Disclaimer Exclusions and Limitations

The information on this web site is provided on an "as is" basis. Uniform Hero reserves the right to modify these terms and conditions at any stage. To the fullest extent permitted by law, Uniform Hero: Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or Uniform Hero's literature; and, Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised Uniform Hero of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
